We are pleased to provide you with our development services on a monthly subscription basis.

1. Overview and Acceptance

Before you start using our services, please take a moment to review the following terms and conditions, which outline the agreement between you (“Subscriber”, “Customer” or “you”) and S.C. Haktos Creative S.R.L. (”ZeroHour”, “Company”, “we”, “us”, or “our”), registered to Str. Panselelor 1, bl. P11, ap. 14, Sannicolau-Mare, Timis, Romania. By subscribing to our services, you agree to comply with these Terms of Service.

2. Subscription Details

2.1 Monthly Subscription

ZeroHour offers frontend development services (the “Service”) on a subscription basis (the “Subscription”). The Subscriber will be charged on a monthly billing cycle.

2.2 Service Modifications

ZeroHour reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that ZeroHour shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

3. No Refund Policy

3.1 Non-Refundable Payments

All subscription fees and payments made to ZeroHour are non-refundable. We do not issue refunds, wether in full or partial, for any reason, including but not limited to early cancellation, dissatisfaction with the Service, or unused portions of Customer’s subscription.

4. Subscription Management

4.1 Automatic Renewals

Customer’s subscription will automatically renew at the end of each billing period unless the Customer cancel before the renewal date. The Customer can manage their Subscription and cancellation preferences through their ZeroHour account.

4.1.1 Customer Notice for Cancellation/Pausing:

The Customer is required to provide a 5-days notice prior to pausing or cancelling their subscription.

4.2 Pausing

The Customer may pause their Subscription at any time by pausing it from the billing portal, provided the notice stated in 4.1.1 was given. This functionality stops payment collection while continuing the billing cycle. The Customer can resume their Subscription at any time.

4.2.1 Notice for Resuming Subscription

Upon pausing, the Customer should notify ZeroHour 7 days in advance to resume their Subscription.

4.3 Cancellation

The Customer may cancel their Subscription at any time by cancelling it from the billing portal, provided the notice stated in 4.1.1 was given. However, no refunds will be provided for any remaining subscription period. Once cancelled, the Customer will continue to have access to our Service until the end of their current billing cycle.

4.3.1 Mutual Cancellation Rights

Both the Customer and ZeroHour reserve the right to cancel the Subscription. The Customer may cancel at any time, provided the notice stated in 4.1.1 was given, while ZeroHour may cancel for any reason, provided a 5-days notice is given. In either case, the Subscription remains active until the end of the current billing cycle, with no refunds for the remaining period.

5. Service Usage Guidelines

5.1 Acceptable Use

Subscriber is expected to use our Service for their intended purpose. Any misuse, abuse, or violation of our Service Usage Guidelines may result in the termination of their Subscription.

5.2 Immediate Termination for Cause

Notwithstanding the above terms, ZeroHour reserves the right to terminate the Customer's subscription immediately and without prior notice in the event of serious breach or violation by the Customer, including but not limited to illegal activities, behavior causing significant harm to ZeroHour or other users, or activities that contravene applicable laws. In such cases, access to the Service will be discontinued immediately upon termination.

6 Intellectual Property Rights

6.1 Source Code Ownership

ZeroHour acknowledges that all source code created on the Customer’s behalf during the provision of the Service belongs to the Customer. The Customer is responsible for all materials provided to us to be incorporated in their project.

7 Confidentiality Obligations

7.1 Confidential Information

Both parties agree to keep any confidential information exchanged during the provision of the Service confidential and not disclose it to third parties without the written consent of the other party.

7.2 Data Protection and Privacy

We comply with all data protection laws applicable to our processing of personal data. For more information about how we process your data, please refer to our Privacy Policy.

8 Liability Limitations

8.1 Disclaimer

ZeroHour provides its Service “as-is” and makes no warranties, express or implied, regarding the performance or availability of the services. In no event shall ZeroHour be liable for any indirect, consequential, or incidental damages arising from the use of our Service.

9 Terms Modification

9.1 Updates

ZeroHour reserves the right to update these Terms of Service at any time. We will notify the Subscriber of any material changes, and it is their responsibility to review and accept the updated Terms.
